Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Member," "you," or "your") and Swap A Set LLC, doing business as SwapASet ("SwapASet," "we," "us," or "our"), governing your access to and use of the SwapASet platform, website, and services (collectively, the "Platform").

By creating an account, accessing the Platform, or participating in any swap, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility & Age Requirements

You must be at least 18 years of age to create an account or use SwapASet. By creating an account, you represent and warrant that you are 18 years of age or older.

SwapASet is intended to be used by adults on behalf of themselves and their families. Minors under the age of 18 may not create accounts or enter into agreements through the Platform. Any account found to be operated by a minor may be immediately terminated without refund.

If you are a parent or guardian facilitating Lego set swaps for your children, you — the adult — are the account holder and are responsible for all activity on the account.

3. Accounts & Membership

Account Creation

To access SwapASet's swap features, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Membership Tiers

• Free: Browse all listings and post unlimited sets. Cannot spend Brick Credits or receive sets.
• Member ($6/month): Full access including spending Brick Credits, requesting and receiving sets, and the Complete Set Guarantee.
• Family Annual ($48/year): Everything in Member plus bonus credits and priority access.

One Account Per Person

Each individual may maintain only one SwapASet account. Creating multiple accounts to circumvent suspensions, bans, or policy limitations is strictly prohibited and will result in permanent termination of all associated accounts.

4. Brick Credits System

Brick Credits are SwapASet's internal exchange currency. They are not real currency, have no cash value, and cannot be transferred, sold, or exchanged for money.

Earning Credits

• Ship a confirmed set to any member: +1 credit (awarded upon delivery confirmation)
• Join bonus for new paid members: +1 credit
• Monthly bonus for active paid members: +1 credit/month
• Receive a 5-star swap rating: +0.5 credits
• Refer a friend who joins as a paid member: +1 credit

Spending Credits

Only paid members ($6/month or $48/year) may spend Brick Credits to request sets. Free members may earn credits by shipping sets but cannot spend them until upgrading to a paid membership.

Credits at Cancellation

Upon cancellation of a paid membership, any unspent Brick Credits are transferred to your free account and held indefinitely. Credits cannot be spent while on the free tier but will be available immediately upon resubscription to a paid plan. Credits do not expire.

5. Swaps & Set Listings

Listing Requirements

All set listings must include accurate information including the official Lego set number, piece count as verified against the Rebrickable database, and at least two photographs: one showing pieces spread flat on a surface and one showing the box condition.

Condition Ratings

• Complete: All pieces present as per the official set manifest
• Mostly Complete: 1–9 minor pieces missing
• Incomplete: 10 or more pieces missing or key pieces absent

Members must accurately represent the condition of their sets. Misrepresentation of condition is a violation of these Terms and subject to the strike policy outlined in Section 8.

Permanent Transfers

All swaps are permanent transfers of ownership. SwapASet is not a rental service. Once a set is shipped and delivered, ownership transfers to the receiving member.

6. Complete Set Guarantee

SwapASet offers a Complete Set Guarantee exclusively to paid members ($6/month or $48/year).

What's Covered

If a paid member receives a set listed as "Complete" that arrives with missing pieces, SwapASet will order replacement pieces from Lego's official Bricks & Pieces service up to a maximum value of $5.00 per swap transaction.

Claim Requirements

• Claim must be submitted within 48 hours of confirmed delivery
• Photo evidence of the received set is required
• Missing pieces must be identified using the official Rebrickable parts manifest
• One claim per swap transaction

What's Not Covered

• Sets listed as "Mostly Complete" or "Incomplete"
• Claims submitted after the 48-hour window
• Claims without photographic evidence
• Missing pieces with a total replacement value exceeding $5.00 (SwapASet will provide a direct link to Lego's Bricks & Pieces service for additional pieces)
• Free tier members

7. Complaints & Dispute Resolution

Filing a Complaint

Any member who believes they have received a misrepresented set may file a complaint through the SwapASet platform within 48 hours of confirmed delivery. All complaints must include photographic evidence. Complaints without evidence will be automatically denied.

Review Process

SwapASet will review all complaints by cross-referencing the original listing photos, the official Rebrickable parts manifest for the set in question, and the evidence submitted by the complaining member. SwapASet's determination is final and binding.

Possible Outcomes

• Complaint Upheld: Sender receives a strike. Paid members receive replacement pieces up to $5.00.
• Complaint Denied: Complaining member receives a note on their account. Repeated unwarranted complaints may result in strikes against the complaining member.
• Inconclusive: No strike issued to either party. No replacement provided.

Financial Liability Cap

SwapASet's total financial liability in connection with any dispute is limited to the $5.00 Complete Set Guarantee. SwapASet is not responsible for the value of any set, shipping costs, or any other financial losses arising from a swap transaction.

Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform that cannot be resolved through SwapASet's internal dispute process shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Hennepin County, Minnesota. You waive any right to participate in class action lawsuits or class-wide arbitration.

8. Violations & Strike Policy

SwapASet maintains a strike system to ensure fair and honest participation. Strikes may be issued to both senders and receivers based on upheld complaints or policy violations.

Strike Expiration

Strikes expire after 12 consecutive months of compliant behavior with no new violations.

Severity Classifications

• Minor violation (e.g., fewer than 10 missing pieces): Follows the standard strike ladder above.
• Significant misrepresentation (e.g., 10 or more missing pieces, or key pieces absent that make the set unbuildable): First offense results in immediate 30-day suspension, bypassing earlier warnings.
• Severe violation (e.g., sending an empty box, sending a completely different set, fraud, harassment, or deliberate misrepresentation): Immediate permanent account termination regardless of prior strike history.

Appeals

Members who receive a temporary suspension may submit a written appeal via email within 14 days of the suspension notice. SwapASet will review appeals and respond within 7 business days. Permanent bans are final and not subject to appeal.

SwapASet's Discretion

SwapASet reserves the right to suspend or terminate any account at its sole discretion for conduct that it determines is harmful to the community, regardless of whether a formal complaint has been filed.

9. Shipping & Delivery

Member Responsibility

The shipping member is responsible for packaging sets securely and shipping within 5 business days of a confirmed swap match. Brick Credits are awarded only upon confirmed delivery via tracking.

Prepaid Labels

SwapASet offers prepaid shipping labels through our integrated shipping partner (Shippo). The cost of the label is charged to the shipping member at the time of label generation. SwapASet earns a small service fee on each label, which is included in the displayed price.

Lost or Damaged Packages

SwapASet is not responsible for packages lost or damaged in transit. If a member purchased shipping insurance through the SwapASet platform at the time of label generation, SwapASet will assist in filing a claim with the carrier. If insurance was not purchased, the shipping member bears sole responsibility for lost or damaged packages.

Local Swaps

Members may arrange local in-person swaps at their own discretion. SwapASet is not responsible for the safety, outcome, or any incidents arising from in-person exchanges. Members are encouraged to meet in public places.

10. Cancellation & Refunds

Voluntary Cancellation

Members may cancel their paid membership at any time. Upon cancellation, access to paid features continues until the end of the current billing period. No partial refunds are issued for unused time in a billing period.

Annual Plans

Members on annual plans ($48/year) are locked in at their rate for the full annual term. Price changes do not apply to active annual subscriptions until renewal.

Termination for Violations

Accounts terminated due to policy violations are not entitled to a refund of any membership fees paid. Brick Credits held in a terminated account are forfeited.

Brick Credits

Brick Credits have no cash value and are non-refundable under any circumstances.

11. Changes to the Platform

SwapASet reserves the right to modify these Terms, the Brick Credits system, membership pricing, and platform features at any time. We will provide 30 days advance notice to existing members via email before any material changes take effect.

Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree to revised Terms, you may cancel your membership before the changes take effect.

Annual plan members are protected from price increases until their current annual term expires.

12. Limitation of Liability

SwapASet is a peer-to-peer marketplace platform. We do not own, sell, or ship any Lego sets. We facilitate connections between members and provide tools to support exchanges.

To the maximum extent permitted by law, SwapASet and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of Brick Credits, dissatisfaction with received sets, or losses arising from swap transactions.

SwapASet's total cumulative liability to any member for any claim arising from use of the Platform shall not exceed the total membership fees paid by that member in the 3 months preceding the claim.

SwapASet is not affiliated with, endorsed by, or sponsored by the LEGO Group. LEGO® is a registered trademark of the LEGO Group.

13. Governing Law & Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Platform shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Hennepin County, Minnesota.

You agree to waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration in connection with any dispute arising from use of the Platform.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration.
